SHIPPED SEMEN
BREEDING CONTRACT
This stallion breeding contract for the breeding season of 2001, is made and
entered into this _____ day of ________________, by and between Diamond M Ranch,
hereinafter designated Breeder, and ___________________________ hereinafter
designated Mare Owner. Mare Owner agrees to breed the mare
___________________________________ to the stallion I'ma Tough Cowboy for the
fee of $750, for a live colored foal, subject to the following conditions:
1. The stallion fee shall be paid with the execution of this contract.
2. The mare to be bred shall be in a healthy and sound breeding condition, free
from infections, etc. A photocopy of registration papers (both sides) must
accompany Breeding Contract prior to shipment of semen.
3. Breeder agrees to diligently try to settle mare and will send the mare owner one shipment of semen included in the stallion service fee. Additional
shipments will require a fee of $150 per shipment to cover the cost of
collection and must be paid in advance. Mare Owner is responsible for all
shipping fees. However, if mare fails to settle, for any reason, Mare Owner will
hold Breeder blameless. Mare Owner agrees to allow Breeder at least three
attempts at settling mare in order to retain breeding privileges for the
following season.
4. This contract contains a live color foal guarantee. A live colored foal is described as a
newborn foal which stands and nurses without assistance and has the appaloosa characteristics described by the ApHC for regular registration. If foal is born dead,
there are return privileges for the current season only if Mare Owner notifies
Breeder within 10 days and submits a veterinarian statement of said foals death.
If after being pronounced in foal (no later than 60 days after breeding), the
mare should miscarry, abort or reabsorb, Mare Owner has the privilege to attempt
rebreeding during the current year, February through June, or the following year
2002.
5. It is further agreed that should the stallion die, be sold, or become unfit
for service prior to breeding the mare, $700 of the breeding fee will be
refunded; if it has been paid to Breeder, thereby cancelling this entire
agreement; or if the mare dies or becomes unfit to breed, the Breeder will
accept another mare according the paragraph #2 as a replacement.
6. This contract is non-assignable and non-transferrable.
7. Mare Owner agrees to return shipping container by express mail at their own
expense within 24 hours from last insemination and enclose ApHC completed
paperwork A late return charge of $50 will be charged if container is not
promptly returned to Diamond M Ranch. A $300 deposit must be made on container
and will be refunded when mare is pronounced in foal and container has been
returned to Breeder intack and without damage. If Breeder has sent semen via
airline, Mare Owner will reimburse Breeder airline freight upon invoice.
8. This contract is entered into in the State of Florida and will be interpreted
and enforced under the laws of Florida in the County of Sarasota.
9. Should either party breach this contract, the breaching party shall pay for
the other's court costs and attorney's fees related to such breach.
10. This contract represents the entire agreement between the parties. No other
agreements or promises, verbal or implied, are included unless specifically
stated herein below:
